Summary

This position is in the FTC, Bureau of Consumer Protection. The Bureau works to protect consumers against unfair or deceptive acts or practices in the marketplace. It conducts investigations, sues companies and people who violate the law, develops rules to protect consumers, and educates consumers and businesses about their rights. The Bureau also collects complaints about fraud, unfair practices, and identity theft and makes them available to law enforcement agencies across the country.

Duties

The Deputy Director for Consumer Privacy (DDCP) of BCP shares in the management of one of the major operating components of the FTC and has responsibility for the investigation, prosecution, policymaking, rulemaking, and compliance functions involved in consumer privacy protection, particularly protecting kids online; for encouraging the business community's compliance with consumer protection laws; and for providing guidance and oversight to the Commission's Divisions and Regional Offices with respect to consumer protection activities. The incumbent also serves as a liaison to the Office of International Affairs (OIA), the Office of Congressional Relations (OCR), and the Office of Policy Planning (OPP) to ensure coordinated and efficient consumer privacy protection policy and enforcement across the agency. Additionally, the incumbent serves as one of six deputy directors assigned to coordinate and oversee the work of BCP Divisions and Regions as appropriate. The Deputy Director for Consumer Privacy is a key member of the Bureau's management team and is delegated to act for the Bureau Director in interpreting and carrying out the Commission's objectives in the broad area of consumer protection, with a focus on consumer privacy protection across Divisions, Regions, and other agency organizations such as OIA, OCR, and OPP. In fulfilling these responsibilities, the DDCP shares with the Director responsibility for establishing consumer privacy policy, particularly protecting kids online, overseeing program direction related to consumer privacy protection, and providing the necessary leadership and strategic planning regarding the Bureau's role in the consumer privacy protection mission. In exercising important policy functions, the incumbent reviews policy recommendations that affect BCP's and the FTC's mission; considers political, social, economic, technical, and administrative factors that may potentially impact recommended policies; and formally recommends action to the approving official. The DDCP, together with subordinate managers and supervisors, serves as a primary link between the Bureau and the Commission, with the incumbent having full signatory authority for all consumer protection matters forwarded. The Deputy Director for Consumer Privacy is a primary factor in ensuring that overall, Bureau resources are used and applied in the most effective manner consistent with resources and budget determinations for consumer protection activities. The incumbent, focusing primarily on consume privacy and protecting kids online, collaborates and shares responsibility in working together with the Bureau Director, Associate Directors, and Regional Directors in planning, organizing, coordinating and evaluating the work of a very large staff of attorneys, investigators, paralegals, other professionals, and supporting technical and administrative personnel. Attorneys assigned to the Bureau determine the theories and plans for investigations in assigned cases and perform the investigative and legal work required, including preparing briefing materials, drafting complaints, negotiating settlements, presenting cases before federal district court judges, and assuring compliance with Commission orders.

TECHNICAL QUALIFICATIONS (TQs): Your resume should demonstrate accomplishments that would satisfy the technical qualifications. TQ 1: Demonstrated knowledge and experience involving the application of the Federal Trade Commission Act and a wide range of statutes, including the Children's Online Privacy Protection Act and its implementing regulations, the TAKE IT DOWN Act, the Fair Credit Reporting Act (FCRA), the Protecting Americans' Data from Foreign Adversaries Act of 2024 (PADFAA), and the Gramm-Leach-Bliley Act and its implementing regulations, including the FTC Safeguards Rule and the Privacy Rule. TQ 2: Demonstrated executive-level experience managing all aspects of litigation, including analyzing complex legal issues and questions of litigation strategy, reviewing pleadings and memoranda, and supervising and reviewing the work of attorneys and other staff. EXECUTIVE CORE QUALIFICATIONS (ECQs): In addition to the Technical Qualification Requirements listed above, all new entrants into the Senior Executive Service (SES) under a career appointment will be assessed for executive competency against the following five mandatory ECQs. ECQ 1: Commitment to the Rule of Law and the Principles of the American Founding - This core qualification requires a demonstrated knowledge of the American system of government, commitment to uphold the Constitution and the rule of law, and commitment to serve the American people. ECQ 2: Driving Efficiency - This core qualification involves the demonstrated ability to strategically and efficiently manage resources, budget effectively, cut wasteful spending, and pursue efficiency through process and technological upgrades. ECQ 3: Merit and Competence - This core qualification involves the demonstrated knowledge, ability and technical competence to effectively and reliably produce work that is of exceptional quality. ECQ 4: Leading People - This core qualification involves the demonstrated ability to lead and inspire a group toward meeting the organization's vision, mission, and goals, and to drive a high-performance, high-accountability culture. This includes, when necessary, the ability to lead people through change and to hold individuals accountable. ECQ 5: Achieving Results - This core qualification involves the demonstrated ability to achieve both individual and organizational results, and to align results to stated goals from superiors. Note: If you are a member of the SES or have been certified through successful participation in an OPM approved SES Candidate Development Program (SESCDP), or have SES reinstatement eligibility, you do not need to respond to the ECQs. Instead, you should attach proof (e.g., SF-50, Certification by OPM's SES Qualifications Review Board (QRB)) of your eligibility for noncompetitive appointment to the SES.

Education

You must possess a J.D. or L.L.B. degree from an accredited law school. If you are qualifying for this position by substituting education or training for experience, submit a copy of your transcripts or equivalent. An official transcript will be required if you are selected. A college or university degree generally must be from an accredited (or pre-accredited) college or university recognized by the U.S. Department of Education. Foreign Education: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.
