Summary
This position is located in the Legal Division, Corporate Operations Branch, Corporate & Legal Operations Section, Freedom of Information and Privacy Act Group of the Federal Deposit Insurance Corporation. Salary reflects a pay cap for this position of $277,500.
Duties
Directing the Corporation's Freedom of Information Act (FOIA) and Privacy Act programs on a day-to-day and oversight basis. Developing and drafting the FDIC's federal regulations, policies and procedures, and Corporation directives regarding the Corporation's compliance with the FOIA, the Privacy Act, and their relationship to other disclosure and privacy laws, rules, and regulations. Training and supervising the training for the employees of the Corporation in the FOIA, the Privacy Act, the FDIC's implementing regulations, and OMB's and DOJ's FOIA and Privacy Act guidance publications. Providing advice and assistance to the Corporation's divisions and offices on FOIA and Privacy Act requirements in making determinations on requests for information, documents, and records, including the review of proposed legislation that would impact the FDIC's privacy and disclosure regulations, policies, and safeguards. Directing and managing staff in the processing of all FOIA and Privacy Act requests for information, from initial receipt through the drafting of FOIA response letters, as well as post-response communications (if necessary), including responding to inquiries from the FDIC's FOIA Public Liaison or to the FDIC's General Counsel (or designee) in the event of an administrative appeal. Researching relevant statutory and case law and writing memoranda of law on complex issues arising from the FOIA, the Privacy Act, and other applicable laws, regulations, and policies that impact proposed FDIC actions. Reviewing responses consistent with established policies and procedures to FOIA or Privacy Act requests and reviewing, as necessary, proposed responses to FOIA and Privacy Act requests submitted by other divisions and offices. Coordinating and discussing responses with other divisions and offices as necessary and resolving any conflicts in appropriate responses. Drafting and reviewing Privacy Act statements and Privacy Act System of Records Notices for publication in the Federal Register as necessary and reviewing notices and statements drafted by staff of the Legal Division, the Executive Secretary, and other divisions and offices. Incumbent discharges all supervisory responsibilities, including, but not limited to, assigning and reviewing work, assessing employee performance, providing counseling and coaching as necessary, and reviewing and approving leave, training, and travel requests. Fulfills labor/management relations responsibilities consistent with established practices and procedures. Manages performance effectively and provides guidance and feedback to help others enhance their knowledge, skills, and abilities. Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious/spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. Leadership Experience: Experience leading and coordinating projects, including establishing expectations, reviewing work products/services, monitoring progress, and providing guidance and feedback to team members; AND Technical Experience: Experience in the administration of a Freedom of Information Act (FOIA) and Privacy Act (PA) program and in the development of a federal agency, corporation, or organization's regulations, policies, and procedures regarding compliance with the FOIA and the PA. Basic Qualification: Active license to practice before the highest court of a state, territory, commonwealth, or the District of Columbia and in good standing.
